Terms & Conditions



Terminology

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements:

“User”, “You”, “Your” and “I” refers to you, the person accessing this website and accepting Holmes Chapel Boxing Club’s terms and conditions.
“The charity”, “Ourselves”, “We” and “Us”, refers to our Organisation, Holmes Chapel Boxing Club.
“Party”, “Parties”, or “Us”, refers to both the user and ourselves, or either the user or ourselves.

All terms refer to the offer, acceptance and consideration of payment necessary to undertake the activities offered by Holmes Chapel Boxing Club in the most appropriate manner, in accordance with and subject to, prevailing English Law.  Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Consent

I/Parents/Guardian (if under 17) hereby consent to myself/them taking part in boxing activity sessions and understand and agree that I/they participate in boxing sessions under the instruction of ABAE qualified coaches entirely at my/they’re own risk. 
I have considered the nature of such sessions and have discussed them with them.   
I am satisfied that I/they is sufficiently responsible and competent to assume responsibility for my/their safety under the supervision of an ABAE qualified coach. 
You hereby agree that there are certain inherent risks and dangers involved in participating in the Classes.  Some of these risks cannot be eliminated regardless of the care taken to avoid injuries.
I confirm that I/they does not have any medical disability or medical condition (not disclosed on medical form) that could affect my/their ability to participate safely in boxing sessions.
I agree to myself/child in my care taking part in the activities of the club.
I understand in the event of injury or illness all reasonable steps will be taken to contact emergency contact and to deal with that injury/illness appropriately.
 
Parents of under 17’s
I have been made aware of and I understand that the club will comply with the ABAE Child Protection Policy and Procedures including changing room, anti bullying, travel, photography or video recording policies.  In view of these policies, I accept that they can be photographed or filmed for coaching or club promotional purposes.  If you do not wish your child's image to be used in this manor please declare so to the Club Secretary
Sport can and does play a major role in promoting inclusion of all groups in society. However, inequalities have traditionally existed within sport, particularly in relation to gender, race and disability. The ABAE is committed to promoting and developing sports equity, which is about fairness in sport, equality of access, recognising inequalities and taking steps to address them. By monitoring the profile of young people in sports clubs, the ABAE and Sport England can identify any issues relating to under-representation of different groups and can together develop strategies to ensure everyone has an opportunity in the future development of sport.   Boxing is a special type of sport whereby it is not suitable or possible to be made safe for everyone to take part and therefore ABAE Rules over-ride any disability discrimination regulations.

Payments

Membership will be subject to a recurring annual charge on the anniversary of your Membership commencement date by direct debit, the amount may change to reflect inflation.  You will be notified of any change by us by email, SMS or Clubright App.

When signing up to monthly direct debit package you are agreeing to Holmes Chapel Boxing Club collecting the monthly fee by direct debit on the 1st of each month. 

How we Use Your Data

By providing your contact details, you are agreeing to us contacting you via Clubright App, SMS and email.

Only the relevant coaches can access this information when required. We also require members’ information for general Health and Safety reasons. In the event of an accident or incident, the information provided will allow HCBC coaches to deal efficiently with the issue. Your data is stored electronically and in cases where we have a manual copy, this will be locked away securely only accessed by the Data Controller.

About Us

Holmes Chapel Boxing Club is a registered charity 1181393. Unit 10 Station Yard, Station Road, Holmes Chapel, CW4 8AA. We are affiliated to and governed by England Boxing.

Force Majeure

Neither party shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond the control of such party including but not limited to any Act of God, terrorism, war, Political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or manmade eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen.

Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavours to comply with the terms and conditions of any agreement contained herein.

Notification of Changes

Holmes Chapel Boxing Club reserves the right to change these conditions from time to time as it sees fit and your continued use of the club will signify your acceptance of any adjustment to these terms.

If there are any changes in how we use our site users’ Personally Identifiable Information, notification by email will be made to those affected by this change.

Any changes to our privacy policy will be posted on our web site – you are therefore advised to re-read this statement on a regular basis

These terms and conditions form part of the agreement between you and ourselves. Your accessing of this website, our App and activities/services and/or undertaking of a booking or agreement indicates your understanding, agreement to and acceptance, of the Disclaimer Notice and the full Terms and Conditions contained herein. Your statutory Consumer Rights are unaffected.
